      <title>Act No. 39 of 2005 - Companies</title>
      <description>
	AN ACT to amend the Companies Act, Chapter 250 of the
Laws of Belize, Revised Edition 2003, to provide that
the Companies and Corporate Affairs Registry shall
be a public office; and to provide for matters connected
therewith or incidental thereto.

BE IT ENACTED, by and with the advice and consent of
the House of Representatives and the Senate of Belize
and by the authority of the same, as follows: -
1. This Act may be cited as the
COMPANIES (AMENDMENT) ACT, 2005,
and shall be read and construed as one with the Companies Act,
which, as amended is hereinafter referred to as the principal Act.
2. Section 259 of the principal Act [added by Act No.
10 of 2004] is hereby repealed and replaced by the following:-
“259. (1) There shall be established under the
Registrar General a Companies and Corporate
Affairs Registry (hereinafter referred to as “ the
Registry”) which shall be a public office.
(2) The Registrar General shall act as
the Registrar of the Registry.
(3) The Registrar General may designate
a public officer to be the Deputy Registrar
of the Registry.
(4) The Attorney General may from
time to time by Order published in the Gazette
prescribe fees for services provided by the
Registry but until such time as such Order is
made, the fees payable immediately before the
commencement of this Act shall remain in force
and continue to be payable.”

all other powers thereunto him enabling.

1. This Order may be cited as the
REVENUE REPLACEMENT DUTY
(CONSOLIDATED) (AMENDMENT) (NO. 5)
ORDER, 2005,
and shall be read and construed as one with the Revenue
Replacement Duty (Consolidated) Order, 2005 which, as
amended, is hereinafter referred to as the principal Order.
2. The Schedule to the principal Order is amended in
the column Rate of Duty as follows:
(i) at item “(10)(i) other motor spirit (premium
gasoline)”, by substituting the words and
figures, “$3.18 per Imperial Gallon”,for
the words and figures, “$3.30 per Imperial
Gallon”, occurring therein;
(ii) at item “(10)(ii) other motor spirit (regular
gasoline)”, by substituting the words and
figures, “$3.08 per Imperial Gallon”,for
the words and figures, “$3.22 per Imperial
Gallon”, occurring therein;
(iii) at item “(11)(i) jet fuel (kerosene)” by
substituting the words and figures, “$0.44
per Imperial Gallon”, for the words and
figures, “$0.57 per Imperial Gallon”,
occurring therein;
(iv) at item “(12) Diesel oil” by substituting
the words and figures, “$1.08 per Imperial
Gallon”, for the words and figures, “$1.20
per Imperial Gallon”, occurring therein;
3. The Revenue Replacement Duty (Consolidated)
Order No.3 is hereby repealed.
4. This Order shall come into force with effect from
the 2nd of September, 2005.
MADE by the Minister of Finance this 31st day of
August, 2005.

      <title>Act No. 30 of 2005 - Public Utilities Commission</title>
      <description>
	AN ACT to amend the Public Utilities Commission Act,
Chapter 223 of the Laws of Belize, Revised Edition
2003, to address the matter of any entrenched rights
in the constitution of a public utility provider which
may be detrimental to the public interest; to provide
for the appointment of an inspector by the Minister
to investigate the affairs of a public utility provider;
and to provide for matters connected therewith or
incidental thereto.

BE IT ENACTED, by and with the advice and consent
of the House of Representatives and the Senate of
Belize and by the authority of the same, as follows: -
1. This Act may be cited as the
PUBLIC UTILITIES COMMISSION
(AMENDMENT) ACT, 2005

and shall be read as one with the Public Utilities Commission
Act, which is hereinafter referred to as the principal
Act.
2. The principal Act is hereby amended by the insertion
of the following new section immediately after section 22:-
22A -(1) It shall be the duty of the Minister
after consultation with the Commission,
Minister of Finance and the Governor of the
Central Bank, to ensure that in relation to any
public utility provider engaged in the provision
of utility services to consumers, there is
free movement of capital and open investment,
and for this purpose the Minister shall
have the power:
(a) to identify and inquire into any entrenched
rights in the constitution of such
public utility provider.
(b) unless satisfied that any entrenched rights
identified under (a) above.
(i) are justified by an overriding
requirement of public policy or
public security; and
(ii) the use of that entrenched right is
necessary in order to meet the
objectives of that overriding
requirement;
to declare the entrenched rights to be unlawful
and of no effect and to enquire into and
confirm all matters relating to the constitu-tion of a public utility provider arising out of
such declaration, including but without limitation
matters arising out of the Memorandum
of Association, Articles of Association,
byelaws, charter or other instrument.”
3. The principal Act is hereby amended by the insertion
of the following new section immediately after section 23:-
“23A Notwithstanding anything contained
in the Companies Act, where an order to
investigate the affairs of a company is sought
in respect of a public utility provider, the
order to appoint a competent inspector shall
be made and the terms of such appointment
shall be decided by the Minister acting on his
own application after consultation with the
Commission, or following an order of the
Court to appoint an inspector under section
110 (1) of the Companies Act, the appointment
of the inspector shall be made and the
terms of such appointment shall be decided
by the Minister, and every appointment and
the terms of every such appointment so made
by the Minister shall be as valid and effectual
as if made by the Court itself."

2003; to increase the age of marriage with parental
consent from fourteen years to sixteen years; and to
provide for matters connected therewith or incidental
thereto.

BE IT ENACTED, by and with the advice and consent
of the House of Representatives and the Senate of
Belize and by the authority of the same, as follows:-
1. This Act may be cited as the
MARRIAGE (AMENDMENT) ACT, 2005,

and shall be read and construed as one with the Marriage Act,
which is hereinafter referred to as the principal Act.
2. Section 4 of the principal Act is hereby amended as
follows:-
(a) in subsection (1), by deleting the words "age of fourteen"
occurring therein and by replacing them by the words
"age of sixteen".
(b) by adding a new subsection (3) immediately after
subsection (2) as follows:-
"(3) A marriage solemnized betweem persons either
of whom is sixteen years of age shall be valid only if
the consent of a person referred to in section 5 is
obtained prior to the solemnization of the marriage".

LOTTERIES CONTROL (VARIATION OF FEES)
(AMENDMENT) ORDER, 2005
which shall be read and construed as one with the Lotteries
Control (Variation of Fees) Order 2002, which is hereinafter
referred to as the principal Order.

2. Paragraph 2 of the principal Order is hereby repealed
and replaced by the following:
“The fines specified in section 7 (1) (b)
of the Lotteries Control Act in respect of
a licence for promoting, holding or
conducting a lottery are hereby varied as
follows-
(i) a quarter year period, two hundred
and fifty dollars;
(ii) a half year period, five hundred
dollars;
(iii) one year, one thousand dollars.

3. This Order shall come into force on the 1st day
of July, 2005.

(THE CIVIL PROCEDURE RULES, 2005)

Pursuant to section 95 of the Supreme Court of Judicature Act, the Chief
Justice with the concurrence of the other Judges of the Supreme Court has
made the following Rules:
SUPREME COURT (CIVIL PROCEDURE) RULES, 2005
1. (1) This Order may be cited as the
SUPREME COURT (CIVIL PROCEDURE) RULES
(COMMENCEMENT) ORDER, 2005.
(2) The Supreme Court (Civil Procedure) Rules, 2005 shall come into
operation subject to the transitional provisions contained in Part 72, on 4th
April, 2005.
2. All Rules of Court relating to the procedure in civil proceedings in the
Supreme Court, save for those relating to insolvency (including winding up of
companies and bankruptcy, and matrimonial proceedings, and non-contentious
probate matters) are hereby revoked with effect from 4th April, 2005.
